America PAC ("America PAC", "Company", "we", "us" or "our") respects the privacy of our visitors and users of our services, and we have prepared this Privacy Policy to demonstrate our commitment to protecting your privacy.

This Privacy Policy describes what personal information we collect, how it is collected, how that personal information may be used internally, to whom that personal information may be disclosed and privacy rights related to personal information.

The terms described in this Privacy Policy apply to visitors to our website, votesafe.org and its surveys hosted on any third party site, including https://www.surveymonkey.com/, and includes any content, functionality, and services offered on or through the website, whether as a visitor or registered users (the "Platform").

Our Personal Information Retention Criteria: Oftentimes, our records contain several of these categories of personal information combined together and therefore we consider, on a case-by-case basis, a number of factors to assess how long personal information is retained, including any periods of time that are permitted or required by law. These factors include what personal information is reasonably necessary to (i) fulfill the purposes for which the personal information was collected; (ii) provide our services or administer our relationship with an individual; (iii) protect our business, employees, organization and others; (iv) fulfill our legal, contractual and regulatory obligations; and (v) investigate and address issues that may include safety concerns, potential security incidents or policy violations.

CHILDREN UNDER 18

The Platform where this Privacy Policy is located is meant for adults. We do not knowingly collect personal information from individuals under the age of 18, and we strive to comply with the provisions of COPPA (The Children's Online Privacy Protection Act). COOKIES AND ELECTRONIC COMMUNICATIONS

You have certain choices about how we collect, use and disclose your information in connection with our use of cookies and our provision of electronic communications. Certain choices you make are browser- and device-specific.

Cookies & Other Tracking Technologies:

Many browsers are set to accept cookies by default. If you disable cookies or refuse to accept a request to place a cookie, it is possible that some parts of our Platform will not function properly, and the advertising you receive when you visit our Platform or other online platforms may not be tailored to your interests. Certain options are browser- and device-specific.

  • Email Tools: You can also change your email settings to block the automatic download of images in email messages, as such images may contain technologies that help us understand how you interact with the message.
  • NAI Opt Out: To opt out of advertising cookies placed by the Network Advertising Initiative ("NAI") online behavioral advertising member networks, and thereby limit the tracking of your online activity and the targeted advertising you receive, please click here.
  • DAA Opt Out: You may also opt out of interest-based advertising from companies participating in the Digital Advertising Alliance program at optout.aboutads.info, and from participating mobile applications through the DAA AppChoices app.

Our Do-Not-Track and Opt-Out Preference Signal Policy: Some browsers have "do not track" features that allow you to tell a website not to track you. These features are not all uniform. We do not currently respond to "do not track" signals. If you block cookies, certain features on our sites may not work. If you block or reject cookies, not all of the tracking described here will stop. We do, however, recognize and honor universal opt-out mechanisms, including the Global Privacy Control (“GPC”). When we detect a GPC signal or other recognized opt-out preference signal sent by your browser or device, we treat it as a valid request to opt out of the sale of your personal information, the sharing of your personal information for targeted advertising, and, where applicable law provides, profiling in furtherance of decisions that produce legal or similarly significant effects. We will process that signal without requiring you to provide any additional information, and we will not treat it as a request to opt out of any other processing. Display Advertising: Our designated service providers assist us with advertisement display functions and related analytics for our websites. Note that even if you exercise choice for targeted advertising, you will still receive general online advertising. Information regarding you and any interactions with us may be collected and utilized to provide you with targeted advertising on the web.

Text Messaging: You may have the opportunity to receive SMS or "text" messages, pre-recorded voice messages or auto-dialed phone calls from us, our affiliates and related entities as well as third parties. Such messaging may be used to authenticate your identity or mobile device, as well as provide you informational updates about services or products you may have requested. In providing your mobile device number or cell phone number to us, that you have the authority to agree to receive text messages at the telephone number that you provide to us, or from which you sent the text message request to us. You further acknowledge that no purchase is required to opt into this service, and you may opt out at any time by following the instructions provided in our communications to you. Any such communications you receive from us will be administered in accordance with your preferences and this Privacy Policy. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP to any message, and you may reply HELP for assistance. We do not sell, rent, or share mobile telephone numbers or text-messaging consent obtained through our text messaging program with third parties for those parties’ own marketing purposes. This limitation applies only to mobile numbers and consent collected through our text messaging program.

YOUR PRIVACY RIGHTS

Below we have included the summary of the rights you may have with respect to the personal information we maintain about you. If you are a Nevada resident, you have the right to submit a verified request directing us not to make any sale of certain personal information about you, as “sale” is defined under Nevada law. You may submit such a request using the contact information below.

We may take steps to verify your identity, as permitted or required under applicable law, before we process your request. Verification may include asking you to provide information about yourself that we can match against information already in our possession. We will respond to your request within 45 days of receipt. Where reasonably necessary, we may extend that period by an additional 45 days, and we will notify you of the extension and the reason for it within the initial 45-day period. We provide at least two methods for submitting requests, as described below.

Please note that we do not knowingly share for targeted marketing purposes or sell the Personal Information of individuals who are under 18 years old. We also do not knowingly process the personal information of individuals under 18 years of age for targeted advertising purposes.

  • Notice/Confirmation of Processing. This means that you can request that we disclose what personal information we have collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we have disclosed personal information, and the specific pieces of Personal Information we have collected about the consumer.
  • Deletion. This means that you can request that we delete personal information about you that we have collected from you.
  • Correction. This means that you can request that we correct inaccurate personal information that we maintain about you.
  • Portability. This means that you can request a copy of the personal information you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the information to another entity without hindrance.
  • Opt Out of Sale of Personal Information. This means you can request to opt out of the "sale" of your personal information, as this term is defined under applicable state law. If you would like to opt out of the sale of your personal information, please note that, in addition to submitting a request below, you will need to disable cookies as described in the Cookies and Electronic Communications section of this Privacy Policy. Please note that the choices you make may be browser- and device-specific, and your choices may be deleted if you clear your browser cache or cookies.
  • Opt Out of Sharing of Personal Information. This means you can request to opt out of sharing of personal information with third parties for targeted marketing purposes. If you would like to opt out of the sharing of your personal information for targeted marketing purposes, please note that, in addition to submitting a request below, you will need to disable cookies as described in the Cookies and Electronic Communications section of this Privacy Policy. Please note that the choices you make may be browser- and device-specific, and your choices may be deleted if you clear your browser cache or cookies.
  • Opt Out of Profiling. This means you can request to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. If you reside in Minnesota, you also have the right to question the result of such profiling, to be informed of the reason the profiling resulted in the decision, and to review and, where appropriate, correct the personal information used in the profiling.
  • Limit the Use and Disclosure of Sensitive Personal Information. If you reside in California, this means you can direct us to limit our use and disclosure of your sensitive personal information to those purposes permitted under applicable law.
  • Withdraw Consent. Where we rely on your consent to process personal information, including sensitive information, you may withdraw that consent at any time. We will stop the processing that relied on your consent as soon as practicable, and in any event within 15 days of receiving your request.
  • Obtain a List of Third Parties. Depending on your state of residence, this means you can request a list of the specific third parties, or the categories of third parties, to which we have disclosed your personal information.
  • Right to Non-Discrimination. This means that we are prohibited from discriminating against you if you exercise your rights under applicable law.
  • Agents that you have authorized to act on your behalf may also submit requests as instructed below. The agent must also provide evidence that they have your written permission to submit a request on your behalf. If we are unable to verify the authenticity of a request, we may ask you for more information or may deny the request.
  • Individuals who wish to exercise their rights under this section may submit a request by either of the following methods: (i) by using our online request form at https://privacy.theamericapac.org; or (ii) by emailing us at info@theamericapac.org. If we deny your rights request and you would like to appeal, you may contact us at info@theamericapac.org. We will respond to your appeal in writing within 45 days of receipt and will explain the reasons for our decision. If we deny your appeal, we will provide you with a method through which you may submit a complaint to your state Attorney General.

ADDITIONAL INFORMATION FOR RHODE ISLAND RESIDENTS: We share personal information for targeted marketing purposes or otherwise sell personal information to the following business partners: Western Creative Group.

SECURITY

The Internet is not 100% secure. We cannot promise that your use of our Platform will be completely safe. We encourage you to use caution when using the Internet. We use reasonable means to safeguard personal information under our control. A user ID and a password may be needed to access certain areas of this Platform. It is your responsibility to protect your username and password. If your password has been compromised, you are required to notify us and change your password.

STORAGE OF INFORMATION

Information we maintain may be stored in or outside of the United States. This Platform is intended for use by individuals who are located in the United States and is subject to the laws of the United States, which may not provide the same level of protections as those in your own country. If you are located outside of the United States, you understand and agree that we may transfer your personal information to the United States.

Our Platform may contain links to other third-party sites that are not governed by this Privacy Policy. If you click on a link to a third-party site, you will be taken to a site we do not control.
